§ 1. General provisions
- These Terms of Service (the "Terms") set out the rules for the provision by electronic means of the BlueWato service (technical project name: myRemDe) — a service providing remote access to the User's computers and devices through a web browser — and the rules for using the websites bluewato.com, bluewato.pl, myremde.com and the panel panel.bluewato.com (alias: panel.myremde.com).
- The Service is provided by Nadmorskie Centrum Internetowe, with its registered office in Puck, ul. Bławatkowa 10, 84-100 Puck, Poland, VAT ID (NIP) PL 586-103-86-56, e-mail: kontakt@nci.pl, tel. +48 58 733 97 00 (the "Provider").
- These Terms constitute terms and conditions for the provision of services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. They are made available free of charge, in a form that allows them to be obtained, reproduced and stored, at bluewato.com/en/terms.
- Registration of an Account requires the User to read and accept these Terms. Acceptance of the Terms constitutes the conclusion of a contract for the provision of the Service on the conditions set out herein.
§ 2. Definitions
- Service — the BlueWato service, comprising the Panel, the signalling server, the TURN relay and the Agent, which enables the User to remotely access the graphical desktop and text console of Devices.
- User — a natural person with full legal capacity, a legal person or an organisational unit without legal personality that has concluded a contract for the provision of the Service.
- Consumer — a User who is a natural person and uses the Service for purposes not directly related to their business or professional activity; the provisions concerning Consumers apply accordingly to sole traders acting with consumer rights (Article 7aa of the Polish Consumer Rights Act).
- Account — the User's individual set of resources and settings in the Panel, protected by an e-mail address, a password and a second authentication factor.
- Panel — the web application available at panel.bluewato.com, used to manage the Account and Devices and to establish Sessions.
- Agent — the Provider's software installed by the User on a Device (Linux / Raspberry Pi, Windows, macOS), which makes the Device's desktop and console available within the Service.
- Device — a computer or other device on which the User has installed the Agent and paired it with the Account.
- Session — a single remote connection (desktop or console) between the User's browser and a Device.
- Plan — a variant of the Service that defines the limits (in particular the number of Devices and the maximum Session duration) and the price, in accordance with the Price List.
- Price List — the information on Plans and prices available at bluewato.com/en/pricing, which forms an integral part of these Terms.
§ 3. Nature and scope of the Service
- The Service enables the User, in particular, to: (a) register and maintain an Account; (b) pair Devices with the Account and manage them (names, categories, status, Agent updates); (c) establish graphical desktop and text console Sessions with Devices; (d) transmit keyboard, mouse and clipboard events within a Session.
- Sessions are established using WebRTC technology in peer-to-peer mode: once the connection is established, Session data (screen image, keyboard, console) is transmitted directly between the User's browser and the Device and is encrypted (DTLS-SRTP). The Provider's servers mediate in establishing the connection (signalling) and — only where a direct connection is not possible — relay the encrypted traffic (TURN), without being able to read it.
- The Provider does not record, store or analyse the content of Sessions (screen image, keystrokes, console commands, clipboard contents).
- The Service is intended for accessing Devices that the User controls or for which the User holds express authorisation. The Service is not intended for uses in which a failure could endanger life or health or cause serious damage (life-support systems, control of critical infrastructure, etc.).
- The Provider may make development versions of the Service ("beta") available, marking them as such in the Panel; such features may be unstable or may be withdrawn.
§ 4. Technical requirements
- Use of the Panel requires: a device with Internet access, an up-to-date web browser supporting WebRTC, WebSocket and JavaScript (e.g. Chrome, Edge, Firefox, Safari) and an active e-mail address.
- Installation of the Agent requires administrator privileges on the Device and one of the following operating systems: Linux (including Raspberry Pi OS; arm64, armv7 and amd64 architectures), Windows 10/11 (amd64, arm64) or macOS 12 or later (Apple Silicon, Intel). A desktop Session on Linux requires an X11 graphical environment; on macOS the Agent must be granted the "Screen Recording" and "Accessibility" permissions.
- The User is responsible for providing, at their own expense, an Internet connection, hardware and software meeting the above requirements, and bears the costs of their use.
- Session quality depends on the connection parameters at both ends. The Service has been designed with low-bandwidth connections in mind and automatically reduces image quality under such conditions.
§ 5. Account and registration
- Registration of an Account consists of providing an e-mail address, a password and, optionally, a display name, and accepting these Terms and the Privacy Policy. The contract is concluded upon confirmation of registration.
- Logging in to the Account requires the password and a one-time code sent to the User's e-mail address (two-factor authentication). The User may mark a browser as trusted for a period of 30 days.
- The User undertakes to: (a) provide accurate information; (b) protect their password and access to their e-mail mailbox; (c) not share the Account with third parties; (d) notify the Provider immediately of any suspected unauthorised access to the Account.
- One person may hold one free Account. Company Accounts may be created by persons authorised to represent the entity.
- A User who is not a Consumer shall ensure that the persons to whom they make Devices available under their Account comply with these Terms, and is liable for their actions as for their own.
§ 6. Rules of use and prohibited conduct
- The User may install the Agent on, and connect to, only those Devices that they own or for which they hold express, demonstrable authorisation from the owner or person in control (e.g. an employer, a client, a family member).
- The following in particular is prohibited: (a) obtaining or attempting to obtain access to devices, systems or data without authorisation; (b) installing the Agent in a manner concealed from the person using the Device, including for the purpose of monitoring persons without their knowledge; (c) using the Service to break the law, including to commit the offences defined in Articles 267–269b of the Polish Penal Code, fraud, stalking or invasion of privacy; (d) distributing malicious software or conducting attacks, scans or security tests against the Provider's infrastructure; (e) circumventing Plan limits, security measures, authentication mechanisms or billing; (f) reverse engineering, decompiling or modifying the Agent or the Panel beyond the extent permitted by law; (g) reselling, renting or making the Service available to third parties as one's own service without the Provider's written consent; (h) generating excessive load on the servers (e.g. automated, mass establishment of Sessions); (i) providing unlawful content.
- A User who makes a Device available to other persons (e.g. an employee's computer, a public kiosk) is obliged to inform those persons of the possibility of remote access to the extent required by law (including employment and data protection law) and is responsible for the lawfulness of such access.
- In the event of a breach of these Terms, the Provider may — depending on the seriousness of the breach — call on the User to cease the breach, restrict Account features, suspend the Account or terminate the contract with immediate effect (§ 14). The Provider shall inform the User of the measures taken by e-mail, stating the reasons, unless this is precluded by law or by the security of the Service.
- The Provider may notify the competent authorities of a reasonable suspicion that an offence has been committed using the Service.
§ 7. Plans, launch period and payments
- The Service is available in the Plans described in the Price List. As at the date these Terms enter into force, these are:
For Users in Poland, prices are expressed in PLN in accordance with the Price List. Prices include VAT.

Until the date on which payments are activated in the Panel (the "Launch Period"), all Plans, including the Business Plan, are made available free of charge. The Provider shall notify Users of the payment activation date by e-mail and by a notice in the Panel at least 30 days in advance. After that date, Accounts for which no paid Plan has been purchased will be switched automatically to the Free Plan with all data retained; the limits of the Free Plan (number of Devices, Session duration) apply from that date. No fee will be charged without the User's express order of a paid Plan.
- The Free Plan is of unlimited duration and does not require the provision of payment details.
- Paid Plans are sold on a monthly or annual subscription basis, renewed automatically for a further period of the same length unless the User cancels the subscription in the Panel before the end of the current period. Cancellation does not entitle the User to a refund of the fee for the current period; the Plan remains active until the end of that period, after which the Account is switched to the Free Plan.
- Payments are handled by the payment operator Stripe (Stripe Payments Europe, Ltd.). Payment card details are transmitted directly to the operator and are not stored by the Provider. The available payment methods are indicated in the Panel.
- An upgrade to a higher Plan takes effect immediately, and the difference in price is charged pro rata up to the end of the current period. A downgrade to a lower Plan takes effect from the beginning of the next billing period.
- Exceeding the Device limit (e.g. after a downgrade) does not result in the removal of Devices; Sessions with Devices in excess of the limit are unavailable until the number of Devices or the Plan is adjusted. A Session in the Free Plan ends automatically after 30 minutes; a new Session may be established immediately.
- VAT invoices are issued in electronic form and made available in the Panel; the User consents to receiving invoices in this form.
- The Provider may change the prices or limits of the Plans. A change does not affect a period that has already been paid for. The Provider shall give notice of a price change by e-mail at least 30 days before it takes effect; a User who does not accept the change may terminate the contract before that date.
§ 8. Right of withdrawal (Consumers)
- A Consumer who has concluded a distance contract may withdraw from it without giving any reason within 14 days of its conclusion (purchase of a paid Plan) by sending a statement by e-mail to kontakt@nci.pl or in writing to the Provider's address. The Consumer may use the model form set out in Annex 2 to the Polish Consumer Rights Act, but this is not obligatory.
- The Service is provided from the moment the Plan is purchased. If the Consumer has requested that provision of the Service begin before the expiry of the withdrawal period, then upon withdrawal the Consumer shall bear the cost of the services performed up to the moment of withdrawal, in proportion to the period of use of the Plan; the Provider shall refund the remaining part of the fee within 14 days using the same payment method.
- The right of withdrawal does not apply to the Free Plan (a contract free of charge); however, the Consumer may delete the Account at any time.
§ 9. Intellectual property and Agent licence
- The Panel, the Agent, the websites, the logos and the names "BlueWato" and "myRemDe", together with their graphic elements, are protected by copyright and belong to the Provider or are used by the Provider under licence (including open-source components, the licences of which are included with the Agent).
- The Provider grants the User a non-exclusive, non-transferable, revocable licence to install and use the Agent on Devices paired with the Account, solely for the purpose of using the Service and for the duration of the contract.
- The User retains all rights to the data and content located on their Devices; the Provider acquires no rights to them.
- The User may submit comments and suggestions to the Provider; the Provider may make use of them without any obligation to pay remuneration.
§ 10. Availability of the Service and changes
- The Provider endeavours to keep the Service available without interruption but does not guarantee any specific level of availability under the Free, Home and Pro Plans. For the Business Plan, a separate service level agreement (SLA) may be concluded.
- The Provider may temporarily restrict access to the Service for maintenance, updates or fault repair, where possible outside working hours and after prior notice in the Panel. Sessions already established (P2P) are, as a rule, not interrupted by work on the servers.
- The Provider may make changes to the Service (new features, interface changes, Agent updates, discontinuation of support for obsolete operating systems), provided that they do not materially reduce the functionality of a paid Plan. The Agent may be updated automatically.
- In the case of Consumers, the changes referred to in paragraph 3 are made in accordance with Article 43r of the Polish Consumer Rights Act; the Provider shall give advance notice of any change that materially and adversely affects access to the Service, and the Consumer may terminate the contract without notice within 30 days.
§ 11. Liability
- The Provider is liable for the conformity of the Service with the contract in accordance with the applicable law, including — in relation to Consumers — Chapter 5b of the Polish Consumer Rights Act.
- The Provider is not liable for: (a) the consequences of actions performed by the User on a Device during a Session (including data loss, configuration changes, damage to the system); (b) unavailability or poor quality of a Session resulting from the Internet connection, hardware, firewall, network operator or Device configuration; (c) the User's disclosure of their password, 2FA code or e-mail mailbox to third parties; (d) unauthorised use of the Service by the User against third parties; (e) force majeure.
- In relation to Users who are not Consumers, the Provider's total liability under the contract is limited to the amount of the fees paid by the User in the 12 months preceding the event and does not cover loss of profit; this limitation does not apply to damage caused intentionally.
- The User bears full responsibility for the lawfulness of access to Devices and for damage caused to third parties or to the Provider as a result of a breach of § 6.
§ 12. Personal data and security
- The Provider is the controller of Users' personal data. The rules for processing data, including the rights of data subjects, are set out in the Privacy Policy; the rules for the use of cookies are set out in the Cookie Policy.
- Where the User, in using the Service, processes third parties' personal data on Devices as a controller, the Provider does not gain access to such data (Session content is transmitted directly and in encrypted form). At the request of a User who is a business, the Provider will enter into a data processing agreement covering Account data and Device metadata.
- The Provider applies the security measures described on the Service website (encryption of transmission, two-factor authentication, passwords stored as Argon2id hashes, signed Session tickets, event log). The Provider shall inform Users of security incidents affecting their Account without undue delay.
- The User may at any time revoke a Device token (disconnect a Device), remove trusted browsers and end active Sessions in the Panel.
§ 13. Complaints
- Complaints concerning the Service may be submitted by e-mail to kontakt@nci.pl or in writing to the Provider's address. A complaint should include the Account e-mail address, a description of the problem and — where possible — the date and time of its occurrence.
- The Provider shall consider the complaint and respond by e-mail within 14 days of its receipt. In the case of a Consumer, failure to respond within this period is deemed acceptance of the complaint.
§ 14. Termination and Account deletion
- The User may terminate the contract at any time with immediate effect by deleting the Account in the Panel (Settings) or by submitting such a request by e-mail. Deletion of the Account results in the disconnection of all Devices and the deletion of Account data within the period specified in the Privacy Policy; the Agent remains on the Devices until uninstalled by the User but no longer connects to the Service.
- The Provider may terminate the contract on 30 days' notice for important reasons, in particular the discontinuation of the Service; the fee for the unused period of a paid Plan is refunded pro rata.
- The Provider may terminate the contract with immediate effect or suspend the Account in the event of a gross breach of § 6, in particular the use of the Service to gain unauthorised access to other people's devices, after first calling on the User to cease the breach, unless an immediate response is necessary for the security of the Service or of third parties.
- Free Accounts on which there has been no login and no Device activity for 12 months may be deleted after prior notification by e-mail given 30 days in advance.
§ 15. Amendments to the Terms
- The Provider may amend these Terms for important reasons, in particular: changes in the law, changes in the scope or manner of providing the Service, the introduction of new Plans or payments, or security considerations.
- The Provider shall give notice of an amendment to the Terms by e-mail and by a notice in the Panel at least 14 days before it takes effect (30 days in the case of price changes). A User who does not accept the amendments may terminate the contract before the date on which they take effect; continued use of the Service after that date constitutes acceptance of the amendments.
- Changes that do not affect Users' rights and obligations (e.g. editorial corrections, updates to contact details) may be made without observing the above notice period.
§ 16. Out-of-court dispute resolution
- A Consumer may use out-of-court means of handling complaints and pursuing claims, in particular: apply to the Voivodeship Inspector of the Trade Inspection (Inspekcja Handlowa) for mediation or to a permanent consumer arbitration court, and seek the assistance of a district (municipal) consumer ombudsman. - A Consumer may also lodge a complaint via the EU online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr. The Provider's contact e-mail address: kontakt@nci.pl.
§ 17. Final provisions
- These Terms are governed by Polish law. In relation to Consumers, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with Users who are not Consumers shall be resolved by the court having jurisdiction over the Provider's registered office.
- These Terms have been drawn up in Polish; versions in other languages are provided for information purposes. In the event of any discrepancy, the Polish version prevails in relation to Users who are not Consumers.
- If any provision of these Terms is found to be invalid, the remaining provisions remain in force.
- These Terms enter into force on 23 August 2026.
